Terms of Service

By accessing or using the Recon Brief service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Any use of the Service will be deemed to be your agreement with, and acceptance of, these Terms.
1. Service description
Recon Brief is an AI-powered document analysis tool that processes deposition transcripts provided to it by the user and thereafter generates summary reports for use by accident reconstruction professionals. The Service produces thematic summaries, chronological summaries, highlighted transcripts, and statements of service.
2. AI accuracy disclaimer
THE SERVICE USES ARTIFICIAL INTELLIGENCE TO ANALYZE AND SUMMARIZE DEPOSITION TRANSCRIPTS. AI-GENERATED OUTPUTS MAY CONTAIN ERRORS, OMISSIONS, INACCURACIES, OR MISATTRIBUTIONS. Specifically:
- The AI may misinterpret testimony, misattribute statements to incorrect speakers, or fail to identify relevant or otherwise critical information.
- Page and line references may be approximate or incorrect.
- The AI may omit critical testimony or include non-substantive information in the summaries or other output.
- Summaries reflect the AI's interpretation of the text and may not accurately represent the deponent's intended meaning.
YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL AI-GENERATED CONTENT AGAINST THE ORIGINAL TRANSCRIPT BEFORE RELYING ON IT FOR ANY PURPOSE, INCLUDING BUT NOT LIMITED TO CASE ANALYSIS, EXPERT REPORTS, TRIAL PREPARATION, USE AT TRIAL, DISCOVERY RESPONSES, OR INQUIRIES.
3. Not medical, legal, engineering or other professional advice
All output of thematic summaries, chronological summaries, highlighted transcripts, and/or statements of service are NOT MEDICAL, LEGAL, OR ENGINEERING OR OTHER PROFESSIONAL ADVICE.
Recon Brief is a document processing tool, not a legal, medical, engineering or other professional service provider, and:
- Does not provide legal advice, legal opinions, or legal analysis.
- Does not provide engineering opinions, conclusions, or determinations of fault, liability, or causation.
- Does not constitute the practice of law or the practice of medicine or professional engineering in any jurisdiction.
- Is not a substitute for the professional judgment of a licensed attorney, medical practitioner or professional engineer.
The summaries generated by the Service are informational extractions only. Any use or re-transmission by any media of the conclusions, opinions, or analyses derived from these summaries, or the results from such use or re-transmission, are the sole responsibility of the user.
4. User responsibilities
By using the Service, you represent and warrant that:
- You have the legal right and authorization to upload and process any of the deposition transcripts or other material you submit to the Service.
- You will review and verify the accuracy and completeness of all AI-generated outputs before relying on them or producing them to any third party, court, tribunal, or opposing party.
- You will not represent AI-generated summaries as human-authored work product without independent verification and review by a competent and qualified expert or professional.
- You will comply with all applicable laws, rules of professional conduct, court orders, and protective orders governing the confidentiality of the documents you process using the Service.
- You are responsible for all activity occurring under your account identity.
5. Data handling and confidentiality
- Uploaded deposition transcripts are transmitted to the Anthropic API for processing. Anthropic's API operates under commercial terms that prohibit the use of customer data for model training. You may review Anthropic's commercial API terms at: https://www.anthropic.com/legal/commercial-terms
- Recon Brief retains generated reports (Outputs) on its servers for thirty (30) days for re-downloading, after which they are automatically and permanently deleted. Original uploaded documents (Inputs) are retained only for the duration necessary to complete the processing and generation of Outputs. Upon successful generation of the Outputs, the original Input file is immediately and permanently deleted from Recon Brief's storage. You acknowledge that the Highlighted Transcript is a derivative work and not a copy of the original Input document.
- Outside of the automated transmission to the Anthropic API for the sole purpose of providing the Service (as described in Section 5(a)), Recon Brief does not sell, share, or distribute your uploaded documents or generated reports to any third party.
- While Recon Brief implements reasonable security measures, NO DATA TRANSMISSION OR STORAGE SYSTEM IS COMPLETELY SECURE. Recon Brief cannot and does not guarantee the absolute security of your data.
- You acknowledge that the use of cloud-based AI processing inherently involves the transmission of document content to third-party infrastructure over the internet, and you accept this as a condition of using the Service.
6. Payment and billing
- The Service is billed on a per-page basis at the rate displayed at the time of submission. The charge is calculated as the total number of pages in the uploaded PDF multiplied by the displayed per-page rate. All pages of the submitted document are included in the page count.
- Charges are final upon successful completion of processing. No refunds are issued for completed processing runs based on dissatisfaction with output content or quality.
- If processing fails due to a system error, no charge is recorded or accrued to your account.
- By authorizing a processing run, you agree to pay the displayed charge for the submitted document(s) in accordance with your account terms.
7. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. RECON BRIEF SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD PARTY CONTENT. THE SERVICE IS USED ENTIRELY AT USER'S SOLE RISK.
Recon Brief does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- The AI-generated outputs will be accurate, complete, or reliable.
- The results obtained from the Service will meet your requirements or expectations, expressed or implied.
- Any errors in the Service will be corrected.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECON BRIEF, ITS OWNER, OPERATORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Damages arising from reliance on AI-generated outputs.
- Damages arising from errors, omissions, or inaccuracies in generated summaries.
- Loss of profits, data, business opportunities, or goodwill.
- Damages arising from unauthorized access to or alteration of your data.
- Damages arising from any third party's use of outputs you produced or distributed using the Service.
IN NO EVENT SHALL RECON BRIEF'S TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE TOTAL FEES PAID BY YOU TO RECON BRIEF IN THE TWELVE (12) CALENDAR MONTHS IMMEDIATELY PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Recon Brief, its owner, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service or any outputs generated by the Service.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or rule of professional conduct.
- Any claim by any third party(ies) arising from your use, distribution, or reliance on outputs generated by the Service.
- Any claim that documents you uploaded to the Service were uploaded without proper authorization.
10. Account security
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify Recon Brief immediately of any unauthorized use of your account.
- Recon Brief is not liable for any loss arising from unauthorized use of your account.
11. Acceptable use
You may not:
- Use the Service to process documents you are not authorized to access or distribute.
- Attempt to reverse engineer, decompile, or extract the source code or prompts used by the Service.
- Resell, sublicense, or redistribute the Service or access to it.
- Use the Service in any way that violates applicable law in any and all jurisdictions.
- Interfere with or disrupt the Service or its infrastructure.
12. Intellectual property
- You retain any rights you have to the deposition transcripts you upload.
- You own the generated outputs (summaries, highlighted transcripts, statements of service) and may use them for any lawful purpose, subject to your obligation to verify accuracy and completeness.
- Recon Brief retains all rights to its software, prompts, methods, and the Service itself.
13. Service availability and modifications
- Recon Brief may modify, suspend, or discontinue the Service at any time without prior notice.
- Recon Brief does not guarantee any specific level of uptime or availability.
- Recon Brief reserves the right to amend or modify these Terms at any time. Continued use of the Service after any such amendment or modification constitutes acceptance of the updated Terms.
14. Termination
Recon Brief may terminate or suspend your access to the Service at any time, with or without cause, with or without notice.
15. Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire agreement
These Terms constitute the entire agreement between you and Recon Brief regarding the use of the Service and supersede any prior agreements. These Terms may not be modified except in writing and affirmatively and expressly agreed to by Recon Brief.
18. Conflict of terms
If you are using the Service under a separate written agreement signed by Recon Brief (such as an Initial Use Agreement), the terms of that written agreement shall control in the event of a conflict with these Terms.
